Affiliate Agreement
This Affiliate Agreement ("Agreement") is established between Enlightening Motherhood LLC, hereinafter referred to as the "Company," and the person opting in as an affiliate, hereinafter referred to as the "Affiliate."
1. Scope of Agreement
By opting in or providing your name and email address and hitting submit, you, hereinafter referred to as the "Affiliate," agree to participate in the Company's affiliate program to promote and market the designated product(s) ("Product"). The Affiliate will refer potential customers to the Product using their unique referral link provided by the platform where the Affiliate signed up.
2. Relationship
The relationship between the Company and the Affiliate is that of independent contractors. This Agreement does not create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.
3. Commission Structure
The Affiliate will earn a commission as specified on the platform where they signed up (i.e. Thrivecart, Systeme.io, etc.) for every referred customer who makes a purchase of the Product using the Affiliate's referral link.
4. Payment
Payments will be made through the platform's designated payment method, using the payment details provided by the Affiliate.
5. Referral Requirements
The referred customer must sign up for the Product exclusively through the Affiliate's unique referral link provided on the platform for the Affiliate to receive credit for the sale. Any sale resulting from a referral not made through the Affiliate's unique link will not be eligible for commission. It is the Affiliate's responsibility to ensure their referral link is used correctly.
6. Patience and Flexibility
The Company acknowledges that the Product may undergo changes or be in various stages of development, and the Affiliate is agreeing to be patient and understanding as the Company navigates the challenges associated with these. Both parties agree to handle the ups and downs with a collaborative and constructive approach.
7. Liabilities
The Affiliate agrees to indemnify, defend, and hold harmless the Company from and against any and all claims, demands, expenses, or liability asserted against the Company arising out of the Affiliate's promotional activities, as well as any breach of this Agreement by the Affiliate.
8. Termination
Either party may terminate this Agreement at any time and for any reason with written notice to the other party or by updating their information on the affiliate platform.
Governing Law This Agreement shall be governed by and construed in accordance with the laws of Arizona, USA.
